"Is Hunter Biden's Legal Team Going to Succeed in Dismissing the Tax Charges in California?"

Amidst the turmoils of the presidential election, son of President Joe Biden, Hunter Biden, has taken center stage in courtroom drama once again. Recently, his lawyers have pushed to have tax charges dismissed by a California judge.




Special counsel David Weiss and his team have accused Biden of failing to pay taxes on $7 million of income from 2016 to 2019, with three felony charges included in the indictment. The prosecution alleges that Biden misclassified personal expenses as business expenses, including payments to an exotic dancer and an escort.


Biden's defense argues that the prosecution's actions have been filled by irregularities, including attacks from Trump and public statements by IRS agents involved in the investigation. They also cite a diversion agreement signed by prosecutors and Biden, which they claim offers immunity on certain charges. Biden's defense attorney Abbe Lowell describes the situation as “the least ordinary prosecution a person could imagine.”

U.S. District Juge Mark C. Scarsi expressed skepticism during the hearing as his case lacked hard evidence for some claims made by Biden's legal team. With a ruling expected by April 17th, the outcome remains uncertain, adding another layer of complexity to an already tumultuous legal battle.


Biden's legal troubles extend beyond California, as he also faces charges in Delaware for allegedly lying on a federal form to purchase a gun in 2018. Despite pleading not guilty, Biden is also accused of illegally possessing a gun.


Biden has pleaded not guilty in both the tax and firearms cases. However, the collapse of a plea deal last July has left him facing two trials this year, raising significant legal and political stakes.


Initially Biden's tax charges were agreed to be settled with a plea deal, where he would plead guilty to misdemeanor tax charges. The deal entailed that Biden would receive a sentence of probation and repayment of back taxes, however the Delaware charges further complicate his legal proceedings resulting in the the deal to fall through.





Consequently, the timing of these trials are significant, as they occur against the backdrop of the 2024 presidential campaign. Hunter Biden's legal battle adds fuel to the already existing political fire. Former President Donal Trump has already embroiled himself in the drama critiquing the handling of Biden's case as given a "sweetheart deal". Furthermore, congressional Republicans have attempted to link Hunter's business dealings to his father, initiating an impeachment inquiry based on unverified claims.


Amidst the legal complexities, Biden's lawyers maintain that the charges are selective and vindictive, pointing to his timely filing and payment of taxes in 2019. They argue that criminal tax charges are unwarranted under these circumstances, highlighting what they perceive as inconsistencies in the prosecution's case.
